Resiin Inc. ("fenel", "we", "us", or "our") operates fenel, a platform for capturing, organizing, sharing, and understanding moments, people, communities, and real-world experiences.

This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices and rights you have. It applies to our apps, websites, communities, Worlds, events, activations, and other products and services that link to it, which we call the "Service." It works together with our Terms of Service.

Resiin Inc. is responsible for your personal information. When we say "personal information," we mean information that identifies you, relates to you, or could reasonably be connected with you.

fenel is built to evolve. As we add features, technologies, partnerships, and business models, we'll keep this Policy up to date. When a change materially affects how we handle your personal information, we'll tell you before it takes effect and ask for your consent where the law requires it.

The short version

• You choose who sees what you share: just you, the people you were with, or the public.
• Public means public. Anything you post publicly can be seen by anyone on the web, including people who don't use fenel, and may be used by community owners or their partners for promotional purposes.
• We never sell or share your private photos, videos, or anything that identifies you. We do create and sell insights that can't identify you.
• Any biometric identifiable information is kept on device and is never shared with our services or any third party services we use.
• Delete your account anytime.

What we collect

What we collect depends on how you use fenel, the experiences you join, and the permissions you give us. It includes:

• Profile and contact information, such as your name, username, photo, email, phone number, organization, role, and social handles.
• Moments and content, such as photos, selfies, videos, audio, voice notes, captions, notes, messages, and other content you share.
• What's in your moments, such as objects, clothing, gear, and brands we recognize in your photos and videos.
• Event and community information, such as the communities, Worlds, events, and experiences you take part in.
• Relationship and interaction information, such as people you interact with, shared moments, introductions, connections, and recurring experiences.
• Location information, general location, and precise location if you turn it on.
• Connected-account information from accounts or services you choose to connect.
• Device and technical information, such as IP address, device type, operating system, browser, app version, and diagnostic information.
• Usage information, such as how you use fenel, including communities, content, searches, QR codes, prompts, and features.
• Communications, including messages, feedback, surveys, and support requests.
• Transaction information about products or services you buy. (Pro subscriptions are handled by Apple, so we never see your card details.)
• Inferences we create from your activity and content, such as your interests, style and brand preferences, relationships, and the experiences you share with others.
• Crash and error diagnostics to identify and fix any errors that occur for users.

Precise location is considered sensitive under some privacy laws. We use it only for the features you turn it on for.

Where it comes from

• From you, when you create an account, share moments, join communities or events, connect with people, or use fenel.
• From other people, when they share content or experiences involving you.
• From organizations you interact with, such as event organizers, brands, athletes, creators, and community builders.
• From services you connect to fenel.
• Automatically, when you use fenel, through cookies, device information, logs, and similar technologies.
• From service providers and partners that help us operate, analyze, and improve fenel.

How we use information

We use information for the purposes below. Each one has a matching legal basis in the EU, UK, and Switzerland section.

• Providing fenel: creating and managing your account and profile; capturing, organizing, storing, and displaying moments; building timelines, journeys, and memories; enabling sharing and collaboration; and connecting moments with people, events, places, and communities.
• Running communities and experiences: operating communities, Worlds, events, and activations, and giving their owners and organizers the tools and analytics described below.
• Personalizing fenel: search, discovery, recommendations, prompts, reminders, challenges, and incentives based on your activity, what's in your moments, and your inferred interests.
• Improving fenel and developing AI: understanding how fenel is used, testing and developing features and products, and developing, evaluating, and improving our AI and machine-learning systems.
• Creating insights: producing anonymized insights about communities, events, and trends, which we use ourselves and may sell or license to others.
• Communicating with you: service, security, and account messages, support, and, where you've agreed or the law allows, marketing about fenel.
• Keeping fenel safe and meeting legal obligations: security, fraud prevention, enforcing our Terms, and complying with the law.

We may also use information for purposes compatible with these, as the law allows. If we want to use your personal information for a new purpose that isn't compatible, we'll tell you first and ask for your consent where required.

Your moments and who sees them

You choose the audience when you share:

• Just you. Your moments stay in your own timeline. This is the default.
• The people you were with. People you share with can see the moment, and it may appear in each of your timelines and journeys.
• The public. Public posts, including posts to communities, can be seen by anyone on the web, including people who don't use fenel, along with your profile name and photo. As these are public webpages, it's possible they may be indexed by search engines or web crawlers.

When you post in a community run by a brand, organizer, athlete, or creator, that community owner can see your post and how you take part.

Moments you appear in

Sometimes you'll appear in someone else's moment. That's part of how shared experiences work. Someone may upload a photo or video you're in, tag you, or connect you to a shared experience.

You can remove tags of yourself. The original content belongs to the person who shared it and may stay available to them and anyone they shared it with. If you'd like content you appear in removed you can use the "report" functionality and community moderators will review the request, or contact us at privacy@fenel.com and we'll review it within 60 days.

How fenel uses AI

AI is at the core of fenel. We use AI, including agents and machine learning, to organize your moments, connect related moments and people, understand context, generate summaries and highlights, power search and recommendations, create prompts and incentives, understand communities and trends, and create insights.

To do this, our AI uses what you share, what's in your photos and videos, when and where you shared it, and how you use fenel. Along the way, it makes inferences about what matters to you, such as your interests and style. AI-generated information isn't always complete or accurate.

• We use our own technology and third-party AI providers. Our providers may process your information only to run fenel and may not use it to train their own models.
• We may use your content and activity to improve fenel's own AI. Where the law requires it, we'll ask first, and you can object.
• We don't use AI to make decisions that have legal or similarly significant effects on you.

What we recognize in your photos

We recognize things in your photos and videos, like shoes, bags, tops, gear, and brands, not who's in them. We use this to organize your moments, personalize fenel, and create anonymized insights. We don't recognize or record items that could reveal sensitive things about you or others, such as religious dress, medical devices, or political symbols.

Face recognition

No biometric data is currently in use by fenel, including face recognition. We may offer it in the future to help you find moments you're part of. If we do, we'll update this Policy first, explain how the feature works and how long face data is kept, and ask for your permission before it's used. It will be optional, and turning it off won't affect the rest of fenel.

Location

We use general location, such as your region, to run and personalize fenel. If you turn on precise location, we use it to connect your moments to events, venues, and places, and to personalize the experiences around them.

We remove location data embedded in photos and videos before they're shared, so other people see the event, not where you were standing. You can turn precise location off anytime in your device settings.

Communities, Worlds, events, and brands

Brands, businesses, event organizers, athletes, creators, and community builders ("community owners") can create, sponsor, or run communities, Worlds, events, and activations on fenel.

Community owners can see the content posted in their community, your profile, and how you take part. We also give them analytics and insights about their community as a whole, such as growth, engagement, top moments, and trends in what people wear or bring. They don't see your precise location or the inferences we make about you.

A community owner may use information it receives for its own purposes, under its own privacy policy, which we link to from the community page.

Anonymized insights

We create anonymized, aggregated insights from activity across fenel, such as how communities grow, how people take part in events, what they engage with, and which brands and styles show up among fans. Insights can reflect what appears in photos, but never include the photos themselves.

We use insights for analytics, research, product development, AI, measurement, and marketing, and we may sell or license them to brands, organizers, partners, and researchers.

Before data becomes an insight, we combine it with data from many people and remove names, photos, videos, voice, contact details, and precise locations. We use recognized anonymization methods and review re-identification risk regularly. Anyone who receives insights must agree not to try to identify anyone.

If information could reasonably identify you, we treat it as personal information, not an insight, and we don't sell it.

Who we share personal information with

We share personal information only:

• with the people, communities, and audiences you choose to share with;
• with community owners, as described above, and with brands you've given permission to use your content;
• with service providers that help us run fenel, such as hosting, storage, security, AI, analytics, communications, payments, and support providers, under contracts that limit how they use it;
• with services you choose to connect;
• with professional advisers, such as lawyers and accountants;
• with authorities or others where the law requires or permits it, or to protect someone's safety or enforce our Terms;
• with parties to a financing, merger, acquisition, or other business transaction, under confidentiality obligations; and
• with anyone else at your direction or with your consent.

We don't sell your personal information

We don't sell or share personal information, as those terms are defined under US state privacy laws, and we haven't in the past 12 months. We don't use it for targeted advertising on other companies' sites or apps. If that ever changes, we'll update this Policy and give you the choices the law requires before it happens.

Selling anonymized insights isn't a sale of personal information, because insights can't identify you.
